Article 1 - Purpose
These terms and conditions of sale govern the sale of watercolour portraits made by Mena, Micro-entreprise (auto-entrepreneur), on the lesmuseauxdemena.fr website.
Article 2 - Prices
Prices are in euros, all taxes included. TVA non applicable, article 293 B du CGI. Standard delivery (La Poste tracked letter) is included in the listed price for shipments to mainland France and the European Union. A Colissimo insured tracked option is available for an additional charge, indicated at checkout.
Article 3 - Custom orders
The portraits are custom artworks made from photos and indications provided by the client. In accordance with article L221-28 of the French Consumer Code, the right of withdrawal does not apply to goods made to consumer specifications or clearly personalised.
However, as a commercial gesture, cancellation is possible within 24 hours of placing the order, as long as the painting has not started. Beyond that period, or as soon as work begins, no refund can be granted.
Article 4 - Payment
Payment is made online by card through the provider Stripe. Banking data is never stored on lesmuseauxdemena.fr.
Article 5 - Lead times and delivery
The production time is 1 to 3 weeks depending on the workload, starting from the receipt of the client's complete photographs. For a custom order or a composition, the timeframe is agreed together during the quote.
The covered delivery zone is mainland France and the European Union. Standard delivery is by La Poste tracked letter (online tracking, no insurance) and is included in the listed price. A Colissimo insured tracked option is available at checkout for an additional charge, for faster delivery and compensation in case of loss or damage.
For shipments outside the European Union, shipping is by quote. Any customs fees remain the responsibility of the client.
Article 6 - Identification of the seller

Article 7 - Description of the artworks
Mena offers watercolour portraits of animals, hand-painted from the photographs provided by the client. Each artwork is unique, painted on fine grain watercolour paper, signed and dated.

The applicable prices are listed on the order page. The artworks are original creations painted by hand: none is generated by artificial intelligence or reproduced by printing. The artisanal nature of each piece implies slight variations in tone and texture, which are an integral part of the artwork.
Article 8 - Order process
Orders are placed exclusively online via the lesmuseauxdemena.fr website. The client:
- chooses the desired size;
- provides one or more photographs of the animal and indicates its name;
- expressly accepts these terms and conditions of sale;
- proceeds to payment.
An order confirmation is sent by email. Mena reserves the right to refuse an order whose photographs would be unusable (insufficient resolution, animal too far away, poor lighting, etc.). In that case, the client is informed without delay and refunded in full.
Custom compositions: orders involving several animals, a custom background or an imagined scene cannot be placed at the standard rate. They must be the subject of a prior quote, the price varying according to the work required.
Article 9 - Legal guarantees
In accordance with articles L217-3 and following of the French Consumer Code, the client benefits from the legal guarantee of conformity for 2 years from delivery. In accordance with articles 1641 and following of the French Civil Code, the client also benefits from the guarantee against hidden defects for 2 years from the discovery of the defect.
Given the artistic nature of the artworks, the stylistic variations inherent to the watercolour technique (transparency, granulation, slight imperfections of the line) do not constitute a defect of conformity.
Article 10 - Intellectual property and rights of use
10.1 - Warranty on the photographs provided
The client guarantees that they have the necessary rights over the photographs they transmit to Mena. The client guarantees Mena against any third-party claim on this matter and authorises Mena to use these photographs as a reference for the production of the commissioned artwork.
10.2 - Ownership of the artwork
The watercolour produced by Mena constitutes an original artistic creation whose copyrights (moral rights and economic rights) remain the exclusive property of Mena, in accordance with articles L111-1 and following of the French Intellectual Property Code, save for written agreement to the contrary.
10.3 - Client's rights of use
The client acquires the artwork for personal and private use. The client has free enjoyment of it in their home and may share photographs of it on their personal social networks while mentioning Mena (@_mena_art_). Any commercial reproduction, sale, printing on derivative products or public distribution requires Mena's prior written agreement.
10.4 - Optional authorisations granted to Mena
At the time of the order, the client may grant Mena additional authorisations regarding the publication of the produced artwork and/or the original photograph of the animal, for portfolio, website, social network and communication purposes. These authorisations are strictly optional and revocable at any time on simple request addressed to Mena via the contact form.
Article 11 - Personal data
The personal data collected (surname, first name, email, delivery address, photographs of the animal) is necessary for the execution of the order. Its processing is detailed in the site's privacy policy.
In accordance with Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act, the client has at all times the right of access, rectification, opposition, erasure and portability of their data. To exercise these rights, the client may contact Mena via the contact form.
Article 12 - Force majeure
Mena cannot be held liable for a delay or non-execution of the order in the event of force majeure (illness, accident, carrier failure, severe weather, etc.). In the event of lasting impediment, Mena shall inform the client as soon as possible and shall propose a postponement or a full refund.
Article 13 - Complaints and dissatisfaction
13.1 - Objective defects (damaged delivery, incorrect size, etc.)
Any objective defect (artwork received damaged, deteriorated support, size delivered different from the size ordered, shipping error) entitles the client to the legal guarantee of conformity (2 years) and the guarantee against hidden defects (2 years from discovery), in accordance with article 9 hereof. The client is invited to report the defect as soon as possible via the contact form, attaching photographs if possible.
13.2 - Aesthetic dissatisfaction (amicable resolution)
A unique artwork has its own subjectivity and cannot be strictly identical to what each person imagines - that's in the nature of artistic practice. If a detail catches your eye, write to Mena soon after delivery via the contact form: a touch-up remains possible when the artwork allows, within reason. This amicable exchange has no contractual character and does not replace the legal guarantee of conformity provided for in article 9.
Article 14 - Consumer mediation
In the event of difficulty, the client is invited to contact Mena as a priority in order to seek an amicable solution, via the contact form.
In accordance with applicable provisions, the consumer client may resort, free of charge, to a consumer mediator in the event of a dispute that is not resolved amicably. The consumer must first have attempted to resolve the dispute directly with Mena before referring to the mediator.

Article 15 - Applicable law and disputes
These terms and conditions of sale are subject to French law.
In the event of a dispute, an amicable solution will be sought as a priority. Failing amicable resolution or mediation, the dispute may be brought before the competent courts under the conditions provided for by law.
Article 16 - Acceptance of the terms and conditions of sale
The client acknowledges having taken note of these terms and conditions of sale before validating their order.
The validation of the order constitutes full and complete acceptance of these terms and conditions of sale.
Article 17 - Modification of the terms and conditions of sale
Mena reserves the right to modify these terms and conditions of sale at any time. The applicable conditions are those in force on the date the order is validated by the client. The date of last update appears at the bottom of this document.
